Main amendments brought by the Ordinance
The relevant amendments in the Ordinance refer to foreigners seconded to Romania and foreigners appointed administrators in Romanian companies.
Under new regulations, the extension of staying rights for foreigners seconded to carry out activities in Romania is granted only if the foreigner has a Romanian work permit.
For expatriates appointed as administrators in Romanian companies, staying right in Romania is granted and extended based on a D/AS type visa on fulfilling the following conditions:
- the individual has a mandate contract;
- for the last two years, the individual was not a shareholder or associate of a Romanian company, including the one in which he is administrator;
- no other foreign national has had staying right extended as administrator of the same Romanian company.
According to the Ordinance, foreigners wanting to extend staying right should furnish the following proof of income:
minimum monthly salary equivalent to the national average salary for expatriates seconded to carry out activities in Romania;
minimum EUR 500, derived from a mandate contract for expatriates appointed administrators in Romanian companies.
Other amendments
Foreign nationals, except those from EU and EEC countries, are obliged to inform the Romanian authorities within three days of entering Romania.
For extending staying right in Romania, the foreigner should hold a social medical insurance.
The Ordinance comes into force 25 July 2005.
