Va aduc la cunosinta urmatoarea problema:
In data de 20.10.2020, eu, impreuna cu sotia am avut un zbor catre Londra. Nu am avut bagaje de cala, deci fara prezenta la check-in, doar la poarta de imbarcare. Acolo, noi am fost primii la coada (eu la priority, ea la non-priority, conform biletelor pe care le aveam). In momentul in care am ajuns la biroul de boarding, am intrebat pe respectivul daca se poate sa-mi iau sotia cu mine, ea fiind insarcinata si fiind prima la coada la non-priority. Mi s-a dat acceptul, apoi am fost imbarcati in autocar. Zborul a decurs fara incidente, nicio problema cu alti pasageri sau cu personalul.
In data de 09.02.2020 sotia primeste un mail de la Ryanair in care ni se transmite urmatoarele:
"Dear 1. Marius Ispas 2. Maria Cristina Ispas ,
I regret to inform you that due to your disruptive behaviour on board Ryanair flight FR1110 on the 20ian.2020, you are hereby prohibited from flying with Ryanair again.
Please be advised that your personal details have been highlighted and you will not be accepted to travel on any Ryanair flight in the future.
Please do not make any reservations for travel with Ryanair as once you log your personal details, our system will highlight your reservation and you will be denied travel without refund."
Sotia a contactat compania prin chat-ul pus la dispozitie pe site si singura informatie primita a fost ca "unul din pasageri a fost agresiv cu personalul de la poarta de imbarcare". Apoi, am continuat cu un mail catre compania aeriana, in care am explicat din nou acelasi lucru pe care l-am scris in primul paragraf, iar in cele din urma am primit astazi, 17.02.2020, urmatorul raspuns:
"Dear Mrs. Ispas,
I refer to your recent correspondence dated 10/02/2020.
Please be advised, according to your reservation, you and your husband showed aggressive behavior, threatening the airport agent's lives.
For the safety and comfort of our customers and crew we adhere to strict guidelines in relation to customers who are disruptive or under the influence of alcohol. In most circumstances customers who create a disturbance at check-in are not permitted to board the plane.
I trust that the above clarifies the situation."
Ieri, am transmis urmatorul mail catre Ryanair:
"Hello,
I’m Marius Ispas, the other passenger of the reservation.
I want to review this case and send us some proofs that we’ve had an aggressive behaviour, because we’ve just only stayed on the line, we were the first passengers and we’ve boarded first in the bus that took us to the airplane. No incident involved, nothing happened between us and the staff or other passengers.
So, it is possible to be a mistake from your part.
Due to this facts, we are not satisfied with your solution to the claim, we ask you to review the case and bring us proofs that we are the aggressive passengers. After that, we kindly ask you to give us a confirmation mail which specifies the unban decision. "
...in urma caruia am primit urmatorul raspuns:
"Dear Mr. Ispas,
I refer to your recent correspondence dated 17/02/2020.
Whilst we sympathize with your view, we regret that our position remains unaltered. We are sorry that we cannot be of further assistance with regards to this matter.
I trust that the above clarifies the situation.
Yours sincerely,
F. Tar
Customer Services"
In momentul actual sunt in urmatoarea situatie: am o sesizare depusa la ECC Romania, cu exact aceleasi lucruri pe care vi le-am enumerat mai sus, inclusiv atasamente cu mail-urile dintre noi si companie si astept raspunsul acestora (in 15 zile de la sesizare) si refuzul clar al celor de la Ryanair.
Avand in vedere ca noi nu am avut niciun comportament agresiv, fizic sau verbal, care banuiesc ca se poate vedea pe inregistrarile aeroportului la care eu, ca persoana fizica nu am acces, revin catre dvs cu urmatoarele intrebari, in eventualitatea in care ii actionez in judecata;
- ce sanse am sa castig? Avand in vedere ca singura proba prin care se poate demonstra ceea ce spun sunt camerele de supraveghere ale aeroportului.
- cat ma costa sa actionez in judecata compania aeriana?
- unde ii actionez in judecata? In Romania, sau in Irlanda, unde au sediul?
P.S.: Nu doresc sa ramana asa cazul, nu stiu cand voi fi nevoit sa zbor cu aceasta companie aeriana si ma voi lovi de refuzul lor.
In speranta ca ma puteti ajuta, va multumesc anticipat.
Din motive de securitate pot refuza transportul, insa acestea trebuie dovedite!
Incercati sa-i somati; daca nu produce efecte, Regulamentul 261 aprobat în 2004 de către Parlamentul și Consiliul European este instrumentul de care vă puteți prevala pentru a obține despăgubiri!
